1) BUSINESS TRANSACTION: OVERNIGHT ACCOMODATIONS

Ariane Schmitz acts as intermediary for clients with lodgins to rent. Ariane Schmitz has no liability for the renting contract, which will be ultimately signed between the landlord and the guest.

2) ACCOMODATION PROPOSAL

The accomodation proposals from landlords / hosts are to be found in Ariane Schmitz's webpage. Ariane Schmitz endorses no warranty or liability as to the accuracy of the proposals placed in her site.

Ariane Schmitz cannot guarantee for the availability of the proposed accomodations. Her role as an intermediary is to check with the landlord whether the lodgins are availabla for the required period. The availability of an accomodation will be confirmed within 24 hours. Should no answer be given within this time span, the client is to assume that the accomodation is not available.

3) PRICES

Prices can change on short notice. Ariane Schmitz does not guarantee the actuality of the given price. Ariane Schmitz as an intermediary will check on the actual price on which the contract will be based. Any change of price after the signature will not affect the contract.

Pictures can give an indication of the lodgins proposed. But Ariane Schmitz cannot guarantee total accuracy.


4) CONTRACT TRANSACTION

The renting contract is firm as soon as the booking with all asked informations and signature of the client / tenant is completed and sent back to Ariane Schmitz (by fax, post letter or as an attachment by email)

5) PAYMENT / DEPOSIT

A deposit is to be transferred to the account of Ariane Schmitz within 2 weeks after the contract is signed and upon receipt of the confirmed reservation. After this deadline all reservations will be cancelled and cancellation regulations adopted.

6) DELIVERY OF BOOKING DATA

The booking data with the name of the landlord and the address of the accomodation will be given only after receipt of the deposit within the above mentioned time period.

7) PAYMENT / BALANCE DUE

The balance due for the whole reservation including all incidental expenses, pledged securities and security deposit is to be paid in advance and in cash on arrival day. Guests will be notified by the landlord after the signature of the contract of variations from this settlement or any other financial deposits made to the landlord.

8) CANCELLATION FROM THE LANDLORD

The landlord/host is obliged to assure the availability of the reserved accommodation for the duration of the reservation. Otherwise, he is responsible for the compensation of the guest in the following manner.

In case of unavailability, the landlord is obliged to reimburse the guest of the complete prepaid downpayment already deposited to the landlord/host as well as the prepaid downpayment made to Ms. Ariane Schmitz. The host is also responsible for paying any additional demands of compensation made in writing by the guest deriving from the unavailability of the accommodation.

  • Cancellations up to 6 weeks before the beginning of the renting period 50,- €
  • Cancellations up to 14 days before the beginning of the renting period 10,- € for every booked night, maximum 150,- €
  • For later cancellations 10,- € for every booked night, maximum 200,- €

The guest/renter explicitly renounces any further demands out of the contract..

9) RESIGNATION FROM THE CONTRACT / CANCELLATION FROM THE GUEST / TENANT

Clients can cancel a reserved accomodation. The cancellation must be in written form sent by email, fax or post letter. The accomodation will be kept available for another person. The client has also the right to find a substitute person for the accomodation at the same conditions negociated.
Following cancellation settlements between the guest and the landlord are to be applied if the accomodation cannot be rented:

For cancellations up to 6 weeks before the renting period 20% of the negotiated renting price, minimum 50,- €
For cancellations up to 14 days before the beginning of the renting period 50% of the negotiated renting price
For later cancellations 100% of the negotiated renting price

20,- € service fee will be charged if Ariane Schmitz's agency can find a substitute person interested in the accomodation for the reserved period at the same conditions. All excess payments within this settlement will be returned. There will be no refund of any sums paid should the tenant leave before the end of the booked period.

Basically there is an obligation to pay for the whole negociated period for a contract period of more than 2 months.

We engage a debt collection company. This company is charging extra money. They will be covered by the debtee.

10) ARRIVAL

TThe site mentions usual arrival time. These can be ascertained or negotiated with the landlord before signing the contract.

In case of unexpected delay please contact the landlord immediatly: he is entitled to rent to another guest after 2 hours of unnotified delay.

11) DEPARTURE

The site mentions usual departure time. These can be ascertained or negociated with the landlord before signing the contract.


12) REGULATION OVER THE USE OF THE ACCOMODATION.

The guest / tenant agrees to the residents' rules. Any disregard of these may entitle the landlord to terminate the contract without refund.

13) LIABILITY

Ariane Schmitz is no tour operator. Therefore tour operator regulations will not apply here. As an intermediary Ariane Schmitz is only liable for criminal intent and gross negligence. Liability for simple carelessness is void. Ariane Schmitz is not responsible for unavoidable disturbances, strikes or breakdowns in the communication systems.

13.1) LIABILITY FOR MISREPRESENTATIONS IN THE ACCOMODATIONS DESCRIPTION

Ariane Schmitz is not responsible for the accuracy of the information given in her site. The landlords are liable. Anything missing or misrepresented should be reported to the landlord immediately. Should later claims arise please contact the landlord immediately.

14) BOOKING OF CLAIMS AND LIMITATION

Claims due to misrepresentations in the guaranteed goods are to be promptly and directly made to the person responsible (landlord). The claim comes under the statute of limitation 6 months after the goods are delivered.

15) DATA PROTECTION

Ariane Schmitz is allowed to get, work on and use landlords and their guests / tenants' personal data as long as this is necessary for the smooth run of the mediation job.

Ariane Schmitz is allowed to use the given data in case of discord of any kind, so as to explain or change her textual organisation and proceedings (inventory). Ariane Schmitz will get, work on and use the booking data within the regulations of law. All booking data should be sent by email, fax or post letter and will be entrusted to Ariane Schmitz towards an all inclusive information standard.

16) SAVING CLAUSE

Should the mentioned regulations of the terms and conditions be void the other regulations will still apply. It is up to the parties to find an equivalent regulation.


17) COURT OF LAW

All issues regarding renting terms fall under the jurisdiction of the part of the town of Berlin in which the accomodation lies. The court of law will therefore always be a district court in the state of Berlin.
